Ain't no stranger
I think it is the little "locking cams" on the latches don't engage well?
Possible there is a rebuild kit to replace those latches and engage correctly or modify it to work better anyone could advise?

Hop onto the Miata Facebook group, reddit group, or miata forums.
I have a 2016 and the miata groups are strong on support... be warned they can also be unrelenting at times.. it's a cult thing with many like Jeeps.

It's a 94 R package, and it's got some pretty bad rust in the usual spots. I don't care about it getting a bit wet, in fact one of my favorite ways to drive it is in the rain with the top down. 😁
I do need to get the rust fixed at some point though. Just dreading dropping $3-4k on that + paint.

Flyin' miata is popular miata tuner company located in colorado. They make good stuff. If you don't want to spend that kind of money, amazon has some knock offs too. If you want to spend no money:

While you're at it, you'll probably want to change the latch caps as well if they're worn out:

All instructions are provided in the links. The lock cap is just an OEM part (P/N: NA01-R1-311).

The latch tension is adjustable.
If I recall, it doesn't even require a tool as it's just a thumb turn.
